But para 12 (6) (b) (iii) makes it clear that bathroom must not be shared with members of any other household.
I believe that covers shower facilities.

What’s amusing me is just how many times the same piece of legislation, sometimes the full document, sometimes only a section, has been copied onto here, around half a dozen times now. But it’s not changed....🧐

The club position is clear, and its not alone in its thinking either, so people will just to have accept it.

"Based on the latest Government guidance, we are unfortunately unable to open our toilets or showers and other indoor shared facilities (excluding receptions) when our Club campsites in England reopen on 12 April. The provisional date for reopening these facilities is currently 17 May 2021, however this will be dependent on Government guidance."
This is copied from email i received from the club, where the ambiguity sets in is in the last sentence, e.g. does this mean they may open before 17 May, on the 17th May or some date in the future, if they had stopped the last sentence at
"The provisional date for reopening these facilities is currently 17 May 2021"
then there would not have been any ambiguity and this is exactly what the commercial site i will be visiting commencing 4th May sent to me via email, great for us as site has quite a large camping fraternity who will not be there, so facilities such as the pool, which will be open will not be so busy and we are happy to use our own facilities, although showering will be a novelty as shower never been used since caravan was new apart from as a cloak room

I have just recieved another Email this time from our MPs office confirming what he advised to me on his preveos comunication
That shared facilities on caravan sites are not permitted to be open for use other than by family members or bubble until the earliest 17th May
And as posted by Whittikerr the section that applies, is not being noted and or read and absorbed by those LAs and other Organisations and are then sending false information to the sites in their counties and members of Organisations

I have just replied to the Email i have recieved suggesting that all LAs and organisations as per some posters have said on here be sent a "round robin" email highlighting Paragraph 12 and the sections before others get mistaken/false info

I presume, now that the Club has made a statement about toilet blocks, that those booked onto sites before 17th May will have a deduction made to their booking if the facilities are closed. The Club are quite happy to charge a not insignificant amount extra for them I wonder if they will have the same view when they are not available?

Paragraph 12, 5b) doesn’t relate to Camp sites.
As a former Civil Servant (44 years) I have read more than a few Statutary Instruments (so called ‘White Papers) before and they are often like wading through treacle.
The relevant information is -
(quote)
(5) Holiday accommodation referred to in sub-paragraph (1) may continue to be provided if that accommodation is provided—
(a)in a campsite or caravan park, provided that the only shared facilities used by guests at the campsite or caravan park are washing facilities, toilets, water points and waste disposal points, or
(b)in separate and self-contained premises.
(6) Premises are separate and self-contained for the purposes of this paragraph only if—
(a)they are provided for persons who are —
(i)members of the same household, or
(ii)members of two households which are linked households in relation to each other, and
(End)
The important word here is the ‘OR’ at the end of sub para 5a).
it’s isn’t an ‘and’ so means the sub para 5b) is not relevant, and therefore neither is sub para 6 as that is qualifying 5b not 5a).
Sorry to be a nerd but according to the law then campsite toilets and washing facilities can open. Whether or not they should is another matter and I couldn’t care less as we will use our own facilities in April, and probably continue to do so for a while after.

Yes the toilets and hand washing facilities could open but as they are mostly in the same building as the showers ( bathrooms) the club has made the correct decision to close them as it would be difficult to keep the toilets and hand washing facilities open and the shower (bathroom) closed.

I always found that the wardens could lock the shower and cubicle doors. Often seen in very early or late season when occupancy is at its lowest when they want to restrict the number of showers etc. to be cleaned.
We stayed at an Independent site last September that did exactly that.
I read the legislation the same way as Ann B. The or is the operative word.

Totally agree... how has this thread been allowed to continue for so long!
It's always been b&w to me, sites open 12th April using own facilities, shared facilities may be opened at the earliest 17th May.....
If you're not happy with this then don't travel.

To summarise, the legal position is that toilets and washblocks can open from 12 April .CMHC choses not to do so. Not because of the law but because they choose not to do so. Me? Im off to Bath Marina Caravan Site which is (legally) opening its washblocks

Do they have 24 hour cleaning staff there? A deep clean is supposed to take place after each person / family bubble have used the facilities.

It will be "interesting?" to see if? an Update to the HMGs road out is forthcoming , after it was pointed out to a member of the cabinet, what was in their rules , when i was advised by the said member, after consulting others that only Family and Bubbles could use any shared facilities
I think the OR is a mistake that was missed
