Insurance Claim
Hi everyone, im hoping someone will be able to help point me in the right direction for claiming for a repair for my caravan.
We went away in October to a site which had two barriers, one was a barrier that stopped cars getting in and the other was an overhead horizontal sliding one which would prevent large vehicles getting in (height restriction).
When we arrived on site with other parties, we all drove in one after the other perfectly without the need to stop.
Upon leaving the site, there was some traffic to leave so i was stuck under the barrier (car was sat underneath), as i went to pull off the horizontal barrier for height restriction had started to close and has caught the front of my caravan and has caused some damage. The site owners came out and said it was their fault and that they would pay for the damage.
However they have now put in a claim against us for causing damage to the barrier. I have contacted the car insurance to claim against them but they are not interested as its only car insurance they deal with, i have also contacted the caravan insurance company who says to contact car insurance company and claim through them. I have search the internet to see who needs to carry out the claim on behalf but getting absolutely nowhere.
Any advice on who i need to contact for a claim it would be greatly appreciated.

The Car Insurers are the ones who will cover this under the Public Liability section as it's damage caused to a Third Party person or property. It's just the same as if you had run into a parked car or wall.
I have no idea why you motor insurers cannot see this. It's one of the basics of their policy.

Perhaps the insurers feel there was an element of negligence by stopping under the barrier and thus consider they have no liability? Just a thought.

One thing that has not been mentioned ,were there any signs as in many places such as "only one vehicle/unit at a time) or wait until exit clear "? if so then you may well be held responsible,
just because several of you entered one behind the other only means that the barriers accepted you all as possibly one unit?

This request was posted last year. Same circumstances and much advice given. At that time the poster was concerned about the caravan claim, who was responsible etc.
Nothing much has happened in the several months since and now this post has appeared. It seems the barrier owner, the caravan site, is making a counter claim against the OP. It was to that part I was referring to when I said this claim should be against the motor insurers, no question. They may investigate and deny liability but that is not the same as we are not covering the OP, just that they decide the OP wasn't liable.
The caravan claim, if it's still outstanding should be made against the Caravan insurers. If they believe the caravan site to be negligent then they will look to have their outlay reimbursed by them or the caravan sites own liability insurers.
Does anyone else remember this post appearing sometime last year?

I recall a similar thread, WN, but the circumstances were a bit different. That incident involved a guy arriving at a site and having an encounter with the barrier although I can’t recall the exact details. He posted a video of the approach to the site.
I don’t think this is the same incident and there's nothing older in R055's profile. Quite a coincidence though that two members should have claims against them for damage to barriers.

We would never stop under a raised barrier. If the way out isn’t clear, just wait until it is, enough to clear your whole outfit🤷♀️ Saves a lot of heartache.
