Parking campervan on private driveway
Hi
I am new here and would like some general assistance, my house has a large private driveway large enough for 6+ cars or 4 medium campervans.
However my house deeds do stipulate no caravans or boats or trailers to be on the property, I appreavite I might need to take some legal advice, but what is the general consensus, is campervan classified as a caravan and does it come under the same umbrella or is that something different. My neighbour is ok with the van, however I want to ensure I am ok longer term with potential new neighbours. The campervan does not obstruct my neighbour light, view or access, as they also have av very large double drive too.

Hmm, was the "No caravans etc " clause inserted by the builder or is it at Local Authorities insistence ? If it is the Builder then the case could be open to persuasion or time considerations -- is the builder still in operation or have they long retired ( Always a good sign if you are trying to change things ) If it is the L.A. I'd do as much fact finding / Research as possible 'cos some are open to reasoned arguments others as rigid as Big Ben !!
Get the neighbours on your side ~~ you could be doing the whole area a favour

How many company and white vans are already parked on peoples drives ? but as has been said, get other neibours on side to help your case
Is it in your deeds as a covenant when house first built? ,if so it would possibly not now be valid

"my house deeds do stipulate no caravans or boats or trailers"
As its none of these I would go ahead.

This question often crops up on MH and C/Van forums. Mostly the best answer is the same.
Talk to your solicitor, preferably the one that carried out the conveyancing for you. He/She should have explained it all to you prior to you signing on the dotted line and will do so again, usually without charge.

A motor caravan is a caravan.

You are in trouble once JV reads this😱😱😊

Precicely!
Back to the subject of the thread though, I think the definitive name for a camper van or camping car or motorhome as the Brtits like to call them, is motor caravan.

If a Motorhome is wrong why is a caravan right🤷🏻♂️. You’ve been at the forefront of calling it a motor caravan citing a Govt website. So I expected you to object to a caravan being called a motor caravan🤔🙄

I have the same words in my deeds and they should be enforced by the LA, but they don’t bother.

Your name of Motor caravan is the name most of us call a motorhome I accept you are right👍🏻. I was saying you are right in calling it motor caravan👍🏻. So you don’t need to tell me it’s the DVLA description as I already know. . .You’ve told us all on numerous occasions👍🏻. I really can’t make it any plainer than that JV. You don’t need to answer this thanks👍🏻

The only action the LA can take is if it is a planning condition, and then in practice they are highly unlikely to. If it is a legal restrictive covenant In the deeds the previous landowner might enforce it (again, highly unlikely). If your property is leasehold then you may have a problem with whoever owns the freehold. Otherwise my advice to anyone is tell anyone who complains to mind their own damn business. In practice there is very little they can do. We have a friend who has a restriction against Enclosing her front garden. Almost all her neighbours have enclosed theirs, she gets in right sweat complaining, the LA simply see her as a busy body because in practice, as they say, what actual harm is being done?

To a certain extent it is all down to the size of the Motorhome, if it is a humongous one then neighbours might start flagging the matter up with your local authority, however if it is a campervan which can also double as your daily driver then it is very highly unlikely that anyone will object.
Mine is a LWB panel van conversion and although there is the clause in the deeds about "no caravans or homes with wheels", I have checked my local District Council as well as the Parish Council and no one is raising any complaints, most especially as it can't be seen from the road.

Some of you may get a surprise in the not too distant future; my LA have banned all caravans, boats and trailers and all commercial vehicles from all new developments. A neighbour of mine was all ready to sign on the dotted line to buy a new house just a mile away from here, but because he works for Western Power and has to take his van home, as he is on call a lot, he had to cancel that purchase because of his van.
These changes are coming from Whitehall to protect residential accommodation. Along with parking cars and courier vans half on road and other half on pavement, which is an offence and LAs are being encouraged to issue fines to offenders.

only in Londinium 😉

Good to see that Covid hasn't stopped Panto.

As a licenced motor vehicle providing you do not sleep in it over night the clause does not apply to you . LAWYER

Have you seen the actual covenant or are you assuming it's something you’ve met before? They're not all the same.
Retired and happy.😃

Exactly - life’s too short to be worrying about something that might happen but probably won’t.
Park it up and forget it...😄

Mines parked on the drive and recently we have been using it as a daily driver, not something you could do with a caravan or trailer, worst case park it on the road, neighbour's complain to the council, so remove it from road and in good faith, park it on your driveway

Surely as your daily drive you have a good argument wherever you live🤷🏻♂️
