I wish you good luck for tomorrow; you deserve to win if only for all the tenacity you've shown! You feel it's the right thing to do, as you believe the site is in the wrong, and you're sticking to your guns. In that, I agree with you, as I firmly believe that you only regret the things you haven't done. I'm not sure that I'd have described everything on an open forum such as this, but everyone is different.
Let us know the outcome tomorrow, there are a lot of us interested

Towing course I DO not need tbh, again some alter ego, I passed a government test to show. (It is quite funny looking through what was said.)
I shown though a test competence in the following:
There are 6 parts to the driving test:
an eyesight check
‘show me, tell me’ vehicle safety questions
reversing your vehicle
general driving ability
independent driving
uncoupling and recoupling the trailer
You’ll drive for around 50 minutes.Eyesight check
You’ll have to read a number plate from a distance of:20 metres for vehicles with a new-style number plate
20.5 metres for vehicles with an old-style number plate‘Show me, tell me’ questions
You’ll be asked 5 vehicle safety questions known as the ‘show me, tell me’ questions. These test that you know how to carry out basic safety checks.Reversing your vehicle
You’ll have to show that you can manoeuvre your car and trailer into a restricted space and stop at a certain point.The examiner will show you a diagram of where to reverse your vehicle.
Your general driving ability
You’ll drive in various road and traffic conditions, including motorways where possible.The examiner will give you directions that you should follow.
Pulling over at the side of the road
You’ll be asked to pull over and pull away during your test, including:normal stops at the side of the road
pulling out from behind a parked vehicle
a hill startIndependent driving
You’ll have to drive for about 10 minutes by following either:traffic signs
a series of verbal directions
a combination of bothUncoupling and recoupling the trailer
You’ll be asked to:uncouple your car from the trailer
park the car alongside the trailer
realign the car with the trailer and recouple themThis test i passed doesnt make me perfect but coupled with 12 years experience I would like to say I was confident!
Its all about being cautious and it boils down to a barrier that comes down, I wasnt aware of for whatever reasons, never advised of and well, the safety devices would have prevailed.

Can I ask, Ian, as an aside just because I’m curious, how did you tow a caravan for 12 years before passing your B+E? Was it a little tiddler of a van?

Tinwheeler, I made a teardrop trailer, Pic attached in 2007, I sold that to buy a lunar chateau, right hand european door and 5 years ago I bought the bailey orion 530-6.
My vauxhall vectra and bailey orion was on the edge of my license, I past mt driving test late 2001 which did not include B+E. I/we wanted a newer vehicle and as the Jaguar XF was more weight than the vectra I had to pass my test to be legal and within the law.

Good evening goodchild , I gave an opinion early in this thread on your plight & I'd just like to say never have I seen a debate on this forum taken in a more friendly way certainty on your part , with various views from so many posters it's actually been a pleasure to follow it .
And may I sincerely wish you best of luck tomorrow , I was hoping my nephew would call to see me so he could view your video & give his personal view / opinion , he's a police officer of 15+ years standing & the last several as a traffic officer.
I'm sure he could assure you that the lack of near side mirror wouldn't be an issue , owing to the incident being on private property & therefore being a civil matter between you & the site .

Twinwheeler, I always check my limits on a weighing scale from the teardrop to the Lunar and to the Bailey. I am cautious of how many tins of beans and tomatoes go into the van on the journey to Dover, She goes mad but I say we will buy them down there. hah

Compass362, I have never been in a forum before and didnt know what to expect!.
I came across it by chance as i wanted reassuring from people who would understand why I done what I done. Everyone has been helpful in some respect!. Many people I know have said ABC your in the right, why didnt the fella in the yellow top warn you and so on. I delved deeper and found out information the site didnt or have lied about want me to know.
On your comment, i have had a traffic officer of a friend I know look at the cctv, as i mentioned previously, he said to me, you have the safety devices polished off in a word, Your point is why did that man in the high viz not tap on your car or shout when he seen what he did.
Thankyou for replying, I will be more than happy, win or lose that I followed What I believed.

I have to disagree with you on that aspect as extended mirrors are definitely not required on private property and I double checked that just in case I was wrong. However just in case I am wrong, do you honestly think that they police will prosecute you for not having extended mirrors fitted while on gated private land to which only a limited section of the public have access.
Either way whether we are right or wrong I hope that somehow the OP is successful with their case even though the odds may be stacked against them.

The police are clearly not the issue. The reasonable precautions and actions taken by yourself and the site owners will be in the eyes of not the police but in those you have requested to sit in judgement. Now where will they seek guidance? I guess the Highway Code and road law will be at the very least a starting point.

Highway code and road legislation would not apply to gated private land in this case, but lets see our the OP does in court. He will be lucky to get a win, but hopefully from reading the various posts on this thread he will be able to counter arguments put forth by the organisation's solicitors.

Well Gentlemen and women, it has all come to an end!
It went really really good considering the odds were stacked against me. A few held out for me I read thanks
Anyways, somewhat of a victory in the fact I didnt lose and I am receiving £62 from the defendants. She split the costs 50/50, i had to pay half theirs and like wise them mine.
The judge was fair TBH.. I made the song and dance about the safety beams sensors and the fob, she took it on board. When I got the two witnesses to admit what the sensors were for, what they stop and detect.
As i stated I made a telephone call to the company who installed the barriers she was going to take what myself and security manager as hear say. I did ask the fella from the company if he could put it into writing but he said no as it was a conflict of interests as they do work for the site still. If I had that info on a document it would have been sealed, stamped and sent.
So I was really looking at parting with £1260 plus costs this morning going to the court, they reduced their counterclaim as they new I could prove the costings wrong.
Just so everyone knows i do have two mirrors now! and I am £62 up.

The only down side to it the judge was a woman, not that it matters but A, she didnt drive and B, never towed a caravan.
Bit like employing a anorexia person to be a food taste tester haha

I have to say you've come out of it better than I expected but I’m assuming you still have to pay for your own repairs. Correct me if I’ve misunderstood.
I'm glad to hear you’ve not been saddled with paying for the barrier repairs and, yes, it is a result but one that only you can say whether it was worthwhile.

In all honesty Tinwheeler I am a person of principal, I can and have known to continue and continue if I believe I am correct.
Had I had the document stating risk assessment it would have certainly been a nail in the coffin for them as they had no risk assessment done.
Yes I had to pay 50 towards theirs and they had to pay towards mine, so i came out ontop really, the van I will sort out.

Presumably the lady knew nothing about barriers either so it could be said she was totally unbiased with no preconceived ideas of blame. Just as it should be.👍🏻

Oneputt, no one had to pay for any legal costs, if i did I would have paid a lot of money out, they had two solicitor's and two witnesses to pay let alone putting the case together as they went hell for leather on the paperwork and so on.
