Evacuation refund....

Hi there we recently stayed at York Rowntree Park and paid for 4 nights. Whilst out in York during the day we got a phone call saying that they were evacuating the site due to a flood warning. We did see the river high but weve been to this site numerous times with high water and this particular weekend was no different. The problem was the council were going to sand bank the road so come the following morning we wouldn't be able to leave. The instructions from site was to come back immediately and pack up and go, so we did.

When we got home we realised that the office never mentioned anything regarding refunding the money we'd paid for extra nights that we cant stay.

I've looked through and I cant see anywhere that it mentions we will get the difference paid back.

Caravan and Camping clearly state on their t&c that they pay out but not CC.

If we cut our trip short without 72 hours notice we'd get no refund but they cancelled on us.

Has anyone had such experiences in this situation?

    There should not be a problem with a refund for your forced evacuation of Rowtree Park contact the Sites department at EGH tomorrow (monday) ,and also there should not be any problem with your canceled (by the evacuation)booking

    Is it in fact an enforcible restriction? I know not. Because something is worded in a contract it does not make it automatically enforceable in law.

    I would have thought that it was a similar situation to people who had to leave sites when the Lockdown was announced? I will highlight to the Community Manager to see if we can get an official response for you.

    It would need proving in a court of law ET, would it be financially worth the risk?🤔

    YRP really does need to have some sort of extra information provided on the booking page for potential visitors, as the flooding happens so frequently. I checked the webpage on Wednesday of last week as I knew it was about to flood again, (but I am practically a local so fully aware of the situation, and how quick the levels come up) but no sign of a flooding warning. As far as I can see, there’s still no warning saying it’s closed. There is a statement around flood work to be carried out next January however. 

    At least if those booking are fore warned, they will know to check the situation, right up to arrival, and can choose to accept or not the “force majeur” clause. It’s not cheap to stay at YRP, but it is a great location. But it can also flood anytime of the year, and there will be some Members perhaps totally unaware of just how easily and frequently this City Centre location floods. 

    Personally, I would think the Club incredibly mean not to refund fees for any full days booked and lost.

    We have been evacuated from Rowntree Park three times in last 20 years and have always been given a full refund for all nights we could not stay on site. 

    Usually refund done within a few days.

    Thanks for the post, it will no doubt reassure the OP.

    I imagine that is how it should be and the slight delay down to site staff making sure that everyone gets off site safely and then securing the site. The admin follows.

    This must surely be a similar situation to when lockdowns are suddenly announced?

    for the small some involved, it might be worth a claim in the small claims court if the club do not cough up, personally i would put it down to experience and be thankful the wardens were on the ball and i had gotten my LV out without incurring any flood damage. laughing

    You should have no problem getting a refund.

    We had to leave Southport early because of the Covid restrictions in North West and got a refund with no problem.

    Just to let you know the evacuation was no false alarm. Within 24hrs of the evacuation the access road (Terry Avenue) was under 3 feet of water. (I live in York). Rowntree Park next door is still closed awaiting a clean up after it was also flooded.

    Ah, that’s the question.😁 It doesn’t have to rain in York for York to flood. It’s all about what happens miles away up in the Dales and the North York Moors. Almost every river in North and West Yorkshire eventually ends up in the Ouse.

    I have to say we were mightily impressed when a holiday cottage contacted us within 12 hours of a local lockdown occurring here in Wales that prevented us taking up a cottage in Yorkshire. They were on the ball and the money refunded that day. So, guess which company I'm using for our next cottage booking?

    I hope the club are similarly speedy in refunding the money.

    Some companies are not so good at refunds. I was talking to an acquaintance yesterday who should have been going to a cottage in Derbyshire next week. They e mailed him to cancel the booking and said that it would take about 45 days before he received his refund!!

    Oh I agree. As you know it took us over 4 months to get a refund for a cruise made by MiL. She's not going to use them again.

    Please be advised if a member leaves the site early due to a site closing for whatever reason then usually the member would be due a refund for any unused nights. Please be assured we will be looking at your booking and a member of the team will be in touch in the next few days.
