Lunar Caravan issue
Hi All,
Could really do with some advice from those in the know. We bought a 2014 lunar in 2016 from a dealer. So it’s still under warranty and we took out a 2 year service plan. In May this year it went in for service and they found greater than 40% damp. The dealer delayed the process of fixing it and obviously Lunar went bust. 7 months on we are still trying to negotiate a resolution. In the interim I looked through all the paperwork that we found in one of the van drawers which we thought was just site information. However I found 3 service reports 2 of which stated that the van had damp. The last one being in 2017 which stated 40% damp. We can find no paperwork that this was remedied. Hence this looks like this is an inherent problem. When we bought the van we were told it had never had damp. The dealer has now agreed to fix the problem but it may take up to 5months, which would mean that our warranty would be close to expiring. We’ve declined this option. We have a face to face meeting tomorrow, so any advice on our rights would be great.

Lunar going scat does not matter in terms of liability as your contract of purchase was with the supplying dealer. Quite where you stand 3 years down the road, I’m not sure.
However, I’m a bit puzzled as you say you bought the van in 2016 yet you discovered a report of the damp dated 2017. Surely that was during your period of ownership?

Apologies the damp report was from 2017 and we bought the van in 2018.

So you’ve only had the van 12 months-ish and the report dates from before you bought it but wasn’t brought to your attention by the dealer. I’d say that strengthens your case against the dealer and, in your shoes, I’d be pushing for a full refund on the grounds that you were not informed of the damp issue and have lost faith in both the van and the dealer's integrity.
I agree with One that the club's legal dept could well be the way to go but it’s a bit late now seeing you're meeting the dealer tomorrow. I suggest checking the internet to establish your position in law in line with the Consumer Rights Act. This might give you a start -
