Help

 

I saw a caravan (used) that I really liked at a dealer. Had a look around it and asked the sales executive what deal we can do. We agreed the prices and I pick it on Monday 10th june

I got a call today saying the motor mover is beyond repair and looks like its from an older caravan!  I asked if money will be taken off for this and was told no but could charge me for removal if wanted it taken off but they wont.

Does anyone think they are correct or I am entitled to a reduction?

    IMHO unless the caravan is particularly rare or uncommon, I'd call his bluff & look for AN Other caravan elsewhere .....

    I would tell them where to get off as well. Did you leave a deposit and, if so was it via credit card?

    I've no idea where you'd stand legally re getting your deposit back etc but you chose the caravan as seen, and as the mover is now not working, then surely he's now selling something that no longer meets the original contract. I'd certainly not be paying him to remove something that (allegedly) no longer works.

    If you are happy with the deal OK. If not then hopefully you used a credit card and I would then write to the dealer to confirm the conversation that the motormover fitted is beyond repair unless in writing already and contact CC company.

    Doesn't the dealer want to sell you this caravan!!  My reading of this is that you have a straight forward case.  I don't think that you would automatically be entitled to a reduction.  However, you bought the caravan 'as seen' with a Mover that you were not told was not working; ergo it was in working order; the fact that it may be from an older caravan is irrelevant. There was probably a notice on the caravan saying in the description etc  'Motor Mover Fitted'.  You paid your deposit.  Quite simply you can cancel the order and get your deposit back,  if you want the caravan without a working mover, they should remove the Mover at their expense or you can cancel the order and get your deposit back.  Contrary to his approach to you, I would try to negotiate a discount on a new mover as the one you thought was ok is now duff.  If the dealer will not play ball remind him, nicely of course, of your rights under the Consumer Protection Act; if no joy involve the Credit Card Company - IF YOU PAID YOUR DEPOSIT BY CARD - who have a legal liability in your case along with the dealer.  Take your Credit Card Company's number with you when you visit the dealer and call them from his showroom, that should make his eyes water.  Saturday afternoon is usually a busy day for dealers!

    The Cruach range are dealer specials, in fact I believe that is a range sold originally by our dealer just outside Glasgow, and as such comes with quite a few "extras" as standard, so the ATC would have been an original feature on the van.

    They do offer good value, but I would still be expecting the mover to either work, or to be replaced by the dealer, at an agreed, discounted price, or to get a reduction as the price you have agreed was to include a mover.

    Have you had it checked over for dampness and the condition of the other appliances?  This dealer's attitude would make me wonder what else may not be working!

    Has this dealer agreed to service the van before you collect ? For your own safety I would ensure  that the van is serviced by an approved engineer and that any defects found are rectified before you acccept the van .Safety certificates for both  gas and electricity are essential

    I was concerned as soon as I saw the words 'sales executive'.

    The mention of the mover being from an older van maybe suggests one swapped over to this van which is quite common for such a high price item.

    I presume that other than the mover issue the OP is happy as he paid a deposit.
