Not happy
last year had a damp repair carried out under warranty,following recent heavy rain the repair appears to have failed .is the dealer required to put right the repair? the vehicle is now out of warranty,however the repair is less than 12 months old,Thanx dave h

Well Sausage George, you may have to fight your corner on this one. Some dealers are better than others as far as customer care is concerned, it may come down to your persitance! I will say though that the dealers I have dealt with have been understanding, try to keep the conversations amicable for as long as possible and leave the hardened approach as a last resort.

I think you should have the expectation of the repair lasting a reasonable amount of time. If you have doubts about what reasonable is in this case why not put the question to trading standards.

The repair should last longer than 12 months and the dealer and caravan manufacturer should still be liable. You may need to check the guarantee but there should be nothing to prevent you claiming. basically the repair has not cured the problem so the failure reported within the warranty period has not been repaired correctly so the claim has not been settled.
The dealer has failed in his duty to carry out the repair diligently and should also be liable.
I would go back and see what they say and hopefully the repair will be done again. If not get stroppy and say you will be taking them to the small claims court for the cost of the work needed. Do not be fobbed off and use the clubs Legal Helpline if need be.
If the dealer does the repair then my advice would then be to get rid just in case the problem reappears in another 12 months..

depends if they were given a 12 month warranty on the repair as a lot of companies including dealers might only give 3 month or even a time that takes it to the end of the original warranty. If you have nothing in writing then you could have a battle on your hands.

The way CRA 2015 works is that if a fault is reported within the first six months, the 6 month is suspended until the fault is rectified. If, for instance, in the last 30 days of the 6 month period a fault is reported, but the dealer takes 3 months to affect the repair, the 6 month period will then kick in again once both parties are happy with the repair.
That repair relating to the fault is then covered for another 6 months. If the same fault re-occurs the consumer may then have good grounds for rejecting the caravan as they do not have to give the dealer another opportunity to repair.
The above applies to both new and second hand goods sold by a supplier.

Sorry but a three month warranty on a repair would not stand up in court. The repair has to be to a professional standard. and one that leaks within 12 months is not good enough.
I doubt though any guarantee was given on a warranty repair.
The dealer and the caravan manufacturer are clearly liable to put it right.

Hope your dealer does as well as ours did when we had damp. They inspected the caravan checked the damp readings and sent off the claim and request for parts immediately. When they had the parts they rang and we were able to get it repaired at a time to suit us, and their service then led us to buy again from them. If the service had been bad then we would have gone elsewhere for a new one.

Thanx everyone for your advice and input, the problem has been sorted, and have been advised if it reappears to take it back again, fingers crossed 🤞 the dealer in question has been excellent
