I guess if it went to crown court with a jury the unanimous verdict would be against you based on the responses on here
However it is not and only will be a judge I guess so lets hope he/she see's it through your eyes and you win.

At first they put it down an accident. I obviously didn't so I proceeded to go to court, then they counterclaimed. An amount that I have to point out to the courts are false.
Sorry I am all over the place but it goes way deeper with their lies which I can prove, I wish I only informed you all from the start tbh.
Anyways keep your fingers crossed and toes for me!

You need to be careful with your choice of words if this is going to court. Insurers can look on web sites and it is possible you could make things more difficult. Good luck if you are proceeding but if there is more to this than you have previously said none of us can make an informed judgement call and you'll need to discuss this in private rather than on here.

I totally agree with brue, if I was you, I wouldn't have posted your most recent post prior to a court case; you have also identified the site in question. I feel sorry for you, being in this predicament, but you must be very careful what you say on an open forum, it's there for all to see!

It strikes me that you have made a rod for your own back.
A few years ago I reversed my car and knocked a recently renovated (probably 20+ year old) motorcycle off its stand. The owner was understandably upset as it had done under 10 miles since he had recently rebuilt it. When he had calmed down I got him to check carefully for damage along with myself. The parts were around £65 and the work for him probably half an hour. I emptied my wallet out and a little over £100 (probably £110) and we had a natter and shook hands. Totally my fault.
It seems to me that for the sake of a few hundred quid (maybe £500) you risk paying travel costs for a couple of witnesses from the defendant and perhaps 'loss of earnings', maybe £200 for the other sides 'expert ' witness, involving your car insurance and your caravan insurance. Was it worth it?

I have towed a caravan for 13 years, I have driven through france, germany, belgium and holland to name a few,
This is my first accident ever when towing! 5 months previous to the accident I passed my B+E entitlement to add to my license, its not as though I just jumped into a car and had a one off trip with a caravan.

Thankyou I understand what you are saying. Everything I have mentioned I have mentioned to the company involved and also the courts.
I am being open and honest about the incident, on the other hand the defendants solicitor is trying their best to have it thrown out of court.
If I am the one to blame then I will accept that and pay for any damage, but I didnt honestly see it for ABC.

Yes to me it is worth it. Its ok looking at CCTV footage from an angle, but you have to remember that I was the driver inside a car which has a total different view from the CCTV.
Wether I am right or wrong, all I ask is think of a time when you were towing and you thought to yourself maybe that's a little close, I will do ABC to be careful. Someone standing at the side of the road would look and think whats that wally doing. Its from a different view point.
I dont mean to argumentative but sometimes I look at the footage and doubt myself but I remember the day very well and it was totally different within the car.

Yes I do understand their position within the umbrella to speak and it doesnt really phase me as I believe I done what I thought was correct and in a safe manner.
I was advised by the company who installed the barrier system, that they, through a risk assessment were advised to have such safety devices fitted but they ignored them at the last minute, probably due to costs. I was advised that these devices would have prevented the incident from occurring.... these such devises have now been fitted. Now think to yourself, who is actually to blame for the incident. Say I go to put a new double socket in for my customer and I dont earth the socket, the customer gets an electric shock. who is to blame? I think it would be me as I did not put the correct measures in place,,, if a barrier system gets installed then the company who requested them should have all safety measures in place at the time of the live date, this means any possible occurrence that could occur as visitors are non of the wiser to the systems.
Just my thoughts and it is not a rant but something to counter what has been mentioned thats all.

I like it. the moral of what I am saying is that i passed a course governed by the driving license agency/government which showed that i was competent within my driving and manoeuvring of a trailer/caravan, again its not like i just jumped into a car and pulled a caravan.
Many people before 2001 passed their driving test which entitled them to tow with catagory B+E, I passed my test in 2002. I wanted to pass the test as i was governed to 3.5 ton maximum combined outfit, I wanted a heaver car to speak which would take me over the threshold,

No doubt he can afford to buy a few Landies outright, me however, self employed I dont have such fortunes hense why i went down the track of a small claims.

Had safety devices been in place (as they are now), they would surely control the barriers seperately? As there had been no vehicle exiting then I would expect the barrier on the exit lane to have closed as it did in the video.

I'd expect that the barrier to stop where it is when it 'sees' something whether entering or leaving.
Try walking under a CC barrier when it's open ..... it'll stop (or at least the entrance barrier at Southport did when SWMBO walked under it 😮)

Prince Philip was aged 14 when driving tests were introduced. B+E is a much more recent innovation. He currently holds an over 70 licence renewed every 3 years in keeping with many of us.
I think the point is that mishaps can happen to anyone and we should all accept that fact.

Yes I agree EasyT, we are human after all, if I do everything within my knowledge and beliefs I will always stand up to them as you can probably see through my replies.
I showed prior that I was competent through the test I mentioned.
I believe the mistake was on, not only the attendant, but also the company for not installing adequate fit for purpose barriers with adequate security devises installed.
Thank you all fellow caravanner's for your input, it is all taken on board and no doubt what you have mentioned in your posts will be thrown at me on Monday.
I just hope this incident does not happen to any of you in the future!

Ps I started my own company and I couldn't afford caravan insurance, I have since got insurance. There was a break of two years and the incident was within this time when I couldnt afford it. I was employed, I had insurance, Redundant - couldnt afford and now i am in the position of that I can afford it. Priority and that.

Hi JVB66, thank-you for the reply to my post. could you elaborate on you feedback, I take it a barrier closed ontop of your motor home and a RV destroyed when it drove off? causing damage?
I see it that electronic or electrical mechanical devises are only as good as the human watching over them! In my case you will know what I am about to say.........
I hate to see any caravan or motorhome damaged!! We work so hard for them..

Yes that is correct Navigateur, although the safety beams that were recommended let alone the remote fobs would have prevented the incident.. safety beams fire an infrared laser across to each side, if the beam is broken it raises or stops the barriers from descending, regardless of two separate lanes the site takes large and wide loads, this should have been incorporated within the system as advised by the installation and manufacturing company, these were not utilised/installed but have been since. Now ask why?
Why have a barrier that comes to the centre line of the road? without adequate devices to detect a wide vehicle entering. If the barrier was down i would have asked the attendant if he could raise it for me to go through as I was, from the start, Cautious.
