Advice re repairs on a 2017 van
I was wondering if anyone could give me advice, I bought a new van in April 2017 and have had nothing but problems. The van has been at the dealers more than we have had it for repairs - one thing after another. After last weekend, the microwave stopped working and we found a wet area in the toilet where the panel was coming away - I am at my wits end now and would like to know if legally I can ask for the van to be taken back - I have no idea on how I legally stand so I would appreciate any help.

Being a veteran of reading forum posts (but not being a lawyer with consumer law experience) I am sure that the answer is no. The timescale for rejecting an item is short and it has to be totally unfit for purpose. Generally the supplier has to be given the option to repair the goods. It’s not like, say, buying an electric kettle which when you plug it in just doesnt work. Nor can you claim for consequential loss e.g. cancelled holidays, time spent, loss of use etc.
From your post it is difficult to establish how severe your problems are but as stated above there is always the option to take the free legal advice available from the Club.
All problems are relative, our Bailey twice went back to the factory for extensive damp repairs and we were without it for several months in all.

I have heard that you have up to 6 years in England and Wales (5 in Scotland) in which you can reject the goods if you can prove they are not 'fit for purpose' legal help would certainly be required.
Are you a member of a union, if so they could provide help. Not sure how good the clubs legal help would be in helping you take a caravan manufacturer to task.
It can be done though as I know of 2 people who have rejected their mh's as not fit for purpose.
Is it the dealer who is at fault or the manufacturer?

In respect to your very powerful rights under the Consumer Rights Act 2015 it is uniquely the dealer. Therefore don't get drawn astray in any way into thinking or being told it is the manufacturer; for you, it is only the dealer.
Ensure everything is documented and chronologically noted down and seek advice now from both the CMC & CAB legal advisers. If any part was on a credit card or HP this could bring other useful tools into play.
Don't let things drift the law is there to help you but you have to be proactive.
The best of luck, though much of that "luck" will be of your own making.

Thankyou for taking the time to comment the van has been back the dealer about seven times in total now since april this year ranging from a new front window, to damp issues and now a faulty microwave, various other faults inbetween, its every time we take the van out which sort of defeats the object, one or two things you can expect bht not the amount we have had, i will definately contact cab see what they say, it just deflates you when its one problem after the other

I know its not nice to keep getting faults with a LV we have certainly had our problems with our MH.
Cracked shower wall - replaced under warranty.
Cracked step into van, also not sealed properly - replaced under warranty
Damaged fridge interior - replaced under warranty
Cracked exterior panel - replaced under warranty
Damp, twice ie 2 years running - fixed under warranty
none of these were the dealers fault, however they were very pro-active in getting things sorted at our convenience which makes a difference as its 180 mile round trip to them.
Your problems new front window and faulty microwave again are not the dealers 'fault' but it is their responsibility to put right. Again you have my sympathy as it is very annoying process to have to go through unfortunately I don't think it matters what make of vehicle you have they all seem to suffer the same issues.

People often talk about rejection but I`ve rarely seen anyone on any forum say they have had success you have to be quick off the mark with a major fault. Some issues such as the microwave not working is`nt the Caravan manufacturers fault. As others have said talk to the clubs legal side they should be able to give advice.
My own small piece of advice its the dealers responsibility to put it right one way or the other, be firm, very firm, but stay calm and polite you need them on your side. (easy to say)
