Warranty warning
In January we purchased a new Adria motorhome from a certain dealership in Newark. At the time we took up the Caravan Club/Adria offer of an extended habitation warranty. We have since discovered we were never registered with Adria for this warranty. The
Club can't advise us on it and Adria can't do anything because we weren't registered at time of purchase even though the dealership claimed that we were. So if you purchased a new Adria caravan or motorhome from this dealership between August 2015 and the
end of January 2016 and took up the extended habitation warranty, please check with Adria as you may find, like us, that you aren't in fact registered for it.

If you paid for it then there is a contract and you need to take it up with the dealer. At worst you are entitled to your money back but I would also ask for damages for the fact if a problem arises you are no longer covered and have lost the benefit. If
you get no joy take out a small claims action, it costs you very little and you can claim your costs and interest. They need a solicitor and even defending it costs hundreds of pounds.0 -
I had a similar situation when I bought a new Swift some 10 years ago. There was a 6 year water ingress warranty. The first 3 years from manufacturer and the second 3 years paid for by the customer used an insurance policy. The van was 4 years old when damp was found. Dealer was to come back to me to arrange for the work. After about 6 weeks I called the dealership a number of times. Never got a reply dispite promises. I became suspicious and contacted the insurer. The insurance had not been put in place. Tried another few times and left messages for the service manager but no calls returned.
I took the morning off work, drove the 20 miles to dealership with OH, let ourselves into the managers office and I sat in his chair with OH alongside until he arrived. Told him what a pratt he was as he knew that the insurance was not in place. He new that they would do the work and that I knew he was going to pay my half days wages and fuel, provide a letter confirming that the work would be done within the next two weeks, the company would provide me with an insurance for the next 3 years up to year 7 and that whilst he was sorting it out we would be having breakfast at the companies expense in a cafe that was attatched. I said I would be back in an hour.
An hour later all sorted, I phoned the insurance company to confirm insurance in place, took my letter and my cash.

Thing is Pippah the manager was being stupid. He new that I had a signed contract. All he had to do was hold his hands up to a simple mistake and try to resolve it in a friendly way. Any customer in my situation would have appreciated that instead of determining
never to use the dealership again.0 -
I don't see what the problem is as a warranty is between the dealership and the manufacturer so that the dealership can get free parts and get paid for labour.
The consumer is covered under the Consumer Rights Act 2015 as the contract is between the dealer and the consumer and not between the consumer and the manufacturer so whether they have registered a caravan for a warranty matters not as the Consumer Rights
Act 2015 over rides any piece of paper which has warranty written on it.I cannot believe that the club were not able to supply any of the information above as it the information is readily available and their legal team should be aware of the legislation.

Whilst I agree Surfer there is another side to the coin. I could have gone down that route when I had my problem. However I wanted the 3 years additional cover to be underwritten by insurance. That would have enabled me to get the work done elswhere if needed.

That's an interesting point now that warranties are for such an extended period. The contract is with the dealer, so if he folds, is the warranty basically worthless notwithstanding it is from the manufacturer?

The warranty is still valid. However if you don't use your own dealer you have to try and find one prepared to do the work if not a back to factory job.

Seaurchin were you not given any paperwork that referred to your extended warranty , and was it not added to your final invoice for payment? If the dealership havenot registered your van with adria then surely they must take out an insurance to cover you
with an extended warranty . Arent most warranties just covered by insurance? Good luck , ps is it the dealership nearest to the A1 ?0 -

Technically you are right but there are two main problems with your approach. To claim against the dealer he has to be there, if he is no longer in business the legal position is no protection.
Secondly the legislation requires you to prove the product was defective when sold. The longer you have had it the more difficult this becomes and it may prove impossible. A good insurance backed warranty is therefore a better bet.

The offer we took out when we purchased our Adria MH was the 5yrs Annual Habitation Service Free Of Charge. (3yrs on a Caravan).
This was exclusive to Caravan Club Members and again ran between 01/08/2015~31/01/2016.
Maybe it's a diffferent offer?

We didn't pay for the offer so will only be out of pocket when we have to pay for habitation checks sooner than expected.
The other warranty work can be carried out by another dealer.
Sadly we have encountered a lot of sloping shoulders.
To end on a positive note... we are thoroughly enjoying our Adria MH having spent 3 out of the last 6 months travelling in it. We plan to continue doing so for a long time to come.

You need a written description of what is covered or how can either of you deal with a dispute and how do you prove you have paid for it. There should at least be some details on a receipt or it is just your word against theirs.
