It is entirely legal to use a use a walkie-talkie or operate amateur radio equipment in a car.
The reason is they use a simplex transmission system rather than the duplex system of a mobile phone.
In plain English, on a simplex transmission you cannot hear the other person whilst you are talking. On a duplex system like a mobile phone you can
That's what the law says .
Of course as some have already posted if you are judged by a policeman not to be in proper control of the car you can be prosecuted for that different offence

Came across this from some time ago and thought I would reply to some of the points raised CB radio is on the 27 mhz and is part of the HF band of the spectrum and normally has an aerial on the roof of the car, a mobile phone is on 800 to 1900 Mhz which is part of the mircowave spectrum and is held to the ear so keep those calls short they have a power output of 0.75 to 1 watt while the legal output power for a CB radio is 12 watts. PMR radios operate on 446 Mhz part the UHF spectrum and have an output of 0.5 watts and I would take a guess which ever brand of PMR radios you buy they will have been built in China. as for using a radio while driving most radio hams build or buy hands free kits as for being legal or not to operate a walkie talkie while driving the cops always have "driving without due care and attention" As for people listening to your conversation this is why radio hams are not allowed to discuss religion or politics on air as we can be heard world wide.
