Autotrail Warranty Issue

It appears that a previous owner of our vehicle omitted to get a habitation service done in 2021 during COVID which is now resulting in our local Autotrail dealer being unable to register a claim for a water ingress problem we have!

Has anyone got any advice to help us out of this difficult situation please.

    What’s the estimated cost of sealing the leak? You may just have to pay to have it done.

    We haven’t got that far yet. The leak has damaged the vinyl ceiling, so it’s not going to be cheap!

    Have you been able to see whether habitation services since 2021 showed up any signs of damp? Taking damp reading at various points around the motorhome is part of a habitation service and if you have the actual service documents, rather than just a stamp in the book you should be able to see in some detail where there were problems if any. . Whilst I suppose manufacturers/dealers will be try and hide behind service conditions, if you can prove that recent services have not shown up a problem it might help to push your claim as clearly a missed service does not seem to have contributed to the problem?

    Thank you, there appears to be no mention of any damp issues in subsequent habitation services.

    Quite simply if the warranty terms were not followed then Auto Trail have no liability unless they transferred the warranty to you. If they did and should have been fully aware of the breach then you could say they waived their right to reject the claim. This would need careful examination of the correspondence and legal advice might be needed. If you did not transfer the warranty then you need to check if this was required.

    As a second owner if you bought the motorhome from a dealer you should have rights against them under the Consumer Relations Act. You would have to show this was a fault that existed at the time of purchase so it will need a bit more investigation to find out.

    If you used a credit card or finance (not a personal loan)you can also claim against the finance company used but again you would need to show the problem pre existed the purchase. If it was less than six months ago though in both cases you would have an automatic right to a repair and if that failed you could claim your money back.

    If it was a private sale unless the seller lied to you your rights against them are almost none existent.

    A bit more detail would help here.

    Thank you for your comments. We bought from a dealer. We are the third owners. We’re hoping to get our service agent to take a good look at it this week and hopefully shed some more light on what the problem is.
