Legal weight limits

I'm looking to buy a new Swift Challenger 524 which has the layout we prefer plus a large rear washroom which also suits us. I'm struggling with the advice about weight limits.

I have a new Nissan Qashqai Accenta Diesel 1.6 which has a tow limit of 1400 kg. the van weighs 1255kg but has a plated weight (MTPLM) of 1405kg so I'm 5kg adrift.

If I buy this van where does it leave me legally? Is it illegal. Even if I load it within the safe limit for the car of 1400kg?
